Amendments to Kyrgyz Patent Legislation

To bring the national patent legislation in line with the Protocol to the Eurasian Patent Convention on the Protection of Industrial Designs, a new edition of the Patent Law of the Kyrgyz Republic came into force on April 7, 2023.

The main changes include:

1. The term of a patent for an industrial design is five years from the date of filing the application now. This term may be extended for additional five-year periods upon request by the patent owner. The maximum term of protection for a patent for an industrial design is 25 years, whereas previously, it was ten years with the possibility of extension for another five years.

2. The maximum term of protection for a utility model patent has been extended from 8 to 10 years.

3. The list of essential features has been excluded from the list of documents required for filing an industrial design application.

4. The possibility of obtaining an invention patent under the applicant’s responsibility is excluded. In the new edition, the examination of a patent for an invention has become mandatory. Thus, it must be carried out upon the applicant’s request, which should be filed to the IP Office within 30 months from the filing date.

5. The new edition allows for the electronic filing of applications for any intellectual property objects.
