A patent is valid within the territory of the country whose patent office has granted it. The exclusive rights to an industrial design conferred by a patent are legally protected only in the country that issued the patent.
It is important to note that a patent obtained in Ukraine provides patent protection only in Ukraine. If the scope of your business interests extends to other countries, it would be advisable to obtain a protection document for an industrial design in each respective country to safeguard your rights internationally.
MSP will be happy to provide you with a full range of services for patenting industrial designs in any country or group of countries of your interest. We handle the entire process of preparing, filing, and further prosecuting the application until the patent is granted in your selected jurisdiction.
Our professionalism and many years of experience in filing both international and national applications in cooperation with patent attorneys in the CIS, Europe, and other foreign countries allows us to successfully represent your interests outside Ukraine.
Protection of intellectual property rights abroad can be achieved either by filing national applications in each selected country or by filing an international application designating several countries with subsequent obtaining a patent in those jurisdictions.
Currently, if you seek legal protection for your design abroad, you have the option of filing an application for international registration of an industrial design under the Hague system and registration of an industrial design in the EU.
Registration procedure under the Hague system
This system allows an industrial design owner to obtain protection in several countries (see list of member countries) by filing a single application with the International Bureau of WIPO in one language and paying a single set of fees in one currency (Swiss francs).
The international registration of an industrial design under the Hague System has the same effect in each designated country as if the design had been registered directly with that country's national office.
Registration procedure in EU countries (European Union design)
An application for registration of an industrial design is filed with the European Union Intellectual Property Office (EUIPO), which is headquartered in Alicante, Spain. By filing a single application in one language and paying a single fee, the owner of a registered design receives legal protection in all 27 member states of the European Union and the United Kingdom. The initial term of protection is 5 years from the date of filing and can be extended up to a maximum of 25 years. If a new state joins the European Union, the legal protection of the registered design automatically extends to the territory of that state.
