Uzbekistan Introduces Criminal Liability for IP Violations

On November 10, 2025, the amendments to the Criminal Code of Uzbekistan will come into force, introducing criminal liability for violations of intellectual property rights. The provisions of new Articles 149(1), 149(2), and 149(3), provide for punishment for unauthorized use of copyrights, trademarks, and patents. Violators may face fines of up to 100 basic calculation units, corrective labor, or imprisonment for up to 2 years. In case of repeated violations or significant damage, the term of imprisonment can reach up to 3 years.
The law is aimed at strengthening protection for holders of rights and combating piracy, which is especially relevant in the context of Uzbekistan's preparation for accession to the World Trade Organization (WTO). The law also includes mitigating provisions. In case of compensation for damages, imprisonment is excluded, and for the first-time violators, exemption from liability is possible provided that the violation is eliminated.
These amendments create a reliable legal basis for protecting innovation, creative industries, and business, contributing to attracting investment in sectors such as IT and pharmaceuticals.
