Patent registration in Azerbaijan allows inventors and companies to obtain legal protection for technical solutions including devices, processes, substances and combinations thereof. Routes to Obtain Patent Protection in Azerbaijan
Patent protection in Azerbaijan may be obtained by filing a national patent application with the Intellectual Property Agency of the Republic of Azerbaijan or via a Eurasian patent designating Azerbaijan.
In the case of a PCT application, protection in Azerbaijan may be pursued by entering the Azerbaijani national phase before the national Office. The deadline is 30 months from the priority date under PCT Article 22 (Chapter I) or 31 months under PCT Article 39(1)(b) (Chapter II).
Inventions may also be protected as Utility Models in Azerbaijan. Utility models offer a simplified registration route; the maximum term of protection is 10 years from the filing date.
Foreign applicants must be represented before the Office by a registered Azerbaijani patent attorney.
Patentability Requirements in Azerbaijan
To obtain a patent in Azerbaijan, an invention must comply with the standard patentability criteria established by Azerbaijani patent law.
- Novelty — the invention shall be considered new if it does not form part of the state of the art, i.e. it has not been disclosed anywhere in the world prior to the filing or priority date.
- Inventive Step — the invention must not be obvious to a person skilled in the relevant technical field.
- Industrial Applicability — the invention must be capable of being made or used in any kind of industry or another practical field.

The term for filing a conventional patent application in Azerbaijan
The validity term of a patent in Azerbaijan is 20 years from the filing date. For pharmaceutical patents and patents for agrochemicals it is possible to apply for extension of this term for additional 5 years. In case a patent is extended, the Supplementary Protection Certificate (SPC) will be issued.
Patent Registration Procedure in Azerbaijan
The procedure of patent registration in Azerbaijan takes from 2 to 3 years. The term for entering the Azerbaijani national phase of a PCT application is 30 months from the priority date under Chapter I and 31 months under Chapter II. The term for filing a conventional patent application in Azerbaijan is 12 months from the priority date.
Filing & Formal Examination
After completion of the filing procedure, an Azerbaijani patent application undergoes a formal examination. After completion of the formal examination, a decision to publish the application is issued. The application is published after payment of the corresponding fee within 2 months.
Substantive Examination (Optional)
Taking into account the positive result of the preliminary examination, the application automatically undergoes the examination in order to determine the compliance of the claimed invention with the patentability criteria. If the results of the examination are positive, the decision to grant a patent is issued. If the registration and publication fees are paid, the patent is issued.
Additionally, the applicant may optionally request conduction of the substantive examination, comprising an additional patent information search and determination of the patentability of the subject matter in Azerbaijan. The mentioned request may be filed within 18 months from the date of filing the application and before a Notification of publication is issued by the Patent Office.
Grant of Patent
If the results of the substantive examination are positive, the decision to grant a patent is issued. After payment of the registration, publication fees and the first post-grant annuities, the patent will be issued.
