PESTICIDES AND AGROCHEMICALS REGISTRATION IN GEORGIA

Trademark in Georgia Pesticide registration procedure in Georgia (Sakartvelo) differs from those in Ukraine, Russia and Kazakhstan and is described below.



Required documents

The following documents should be filed to the Ministry of Agriculture of Georgia for pesticide registration:

  • information about the pesticide (dossier);
  • a methodology of identification of the active ingredient in the preparation;
  • a methodology of determination of pesticide's residues in agricultural products, water, soil, air and biomaterials;
  • official information from country of origin on regulated use of pesticides;
  • a sample of packing label and promotional materials;
  • recommendations about storage, transportation of product and the methods of neutralization and liquidation;
  • official data which confirms that the active substance at the moment of registration is included in the first attachment of the ECC 91/414 regulation;
  • information about the validity of patent on the active ingredient and on the preparation, if any;
  • Material Safety Data Sheet (MSDS) on the pesticide from a manufacturer;
  • Certificate of Analysis (COA) on the pesticide preparation and on the active ingredient from a manufacturer;
  • the document confirming the right on registration of the pesticide preparation issued from the manufacturer;
  • information about the results of the researches conducted in the countries which have equivalent climate and ecological conditions;
  • Power of Attorney from the applicant to the representative.

Registration procedure

Pesticide registration procedure in Georgia consists of the following steps:

1. Filing the request to register the pesticide preparation as well as the abovementioned required documents with the Ministry of Agriculture of Georgia.

2. Consideration of the application by the Ministry of Agriculture of Georgia;

3. Concluding the agreements with the institutes which prepare toxicity and hygienic assessment as well as bioassay;

4. Obtainment of the permission for experimental samples importation from the Ministry of Agriculture of Georgia;

5. Carrying out the above-mentioned assessments during one-two vegetation periods (this term may be limited to one vegetation period if the pesticide contains an active ingredient which is well-known in Georgia (Sakartvelo);

6. Examination of the results of conducted researches in the Laboratory of the Ministry of Agriculture of Georgia during not longer than three months, paying the corresponding official fee;

7. Paying the official fee for the registration of the preparation and issuance of the Certificate about state registration by the Ministry of Agriculture of Georgia.


Types of examination

The important fact is that according to Georgian legislation there are three types of the pesticides examination and they are the following:

1. In case the documents on the pesticide preparation are issued in the EU country that is similar to South-East climate zone of Georgia, namely Bulgaria, Hungary, Romania, Slovakia, Slovenia, Croatia, the registration of the preparation is carried out on the basis of the consideration of the registration dossier only by the Ministry of Agriculture of Georgia provided that the pesticide preparation is used on the same crops and against the same pests.

2. In case the documents on the pesticide preparation are issued in the EU country member of OECD the registration of the pesticide preparation is carried out on the basis of the consideration of the registration dossier by the Ministry of Agriculture of Georgia and examination of the results of the researches conducted in corresponding country by the Laboratory of the Ministry of Agriculture of Georgia.

3. In case the documents on the pesticide preparation are issued in country which doesn't belong neither to EU countries nor the OECD Member States the registration of the pesticide preparation is carried out on the basis of the consideration of the registration dossier by the Ministry of Agriculture of Georgia, conduction of the required registration researches by the institutes and examination of the results of the researches conducted in corresponding country by the Laboratory of the Ministry of Agriculture of Georgia.


Validity term of the registration

In case the Ministry of Agriculture of Georgia considers that the information on the pesticide preparation or other information regarding the pesticide preparation is insufficient or there is the lack of research data on the pesticide preparation the product is registered for three years. During three-year registration it is possible to conduct additional required tests and basing on the results of the tests the Ministry of Agriculture of Georgia may consider to register the pesticide preparation for five years.
