SHORT-TERM PATENT IN MOLDOVA

The validity term of a short-term in Moldova is 10 years from the date of filing, i.e. 6 basic years extendible for additional 4-year term.

A 6-month grace period term is applied only if disclosure took place at the international exhibition or by the third parties in bad faith.

According to the Moldavian legislation the application for a short-term patent should relate to one invention or a group of inventions, united by the single inventive idea. The object of the short-term patent application may be the same as of the regular patent application, namely a product, process, or a new use of the already known product or process.

Overview of the short-term patent registration procedure in Moldova:
Applications for a short-term patent in Moldova undergo formal and preliminary examination. The Examination Board examines formal requirement and the fact that no patents/short-term patents have already been issued for the same invention in Moldova. If the application for a short-term patent satisfies the requirements of the formal and preliminary examination, then the decision on granting a patent is taken. If the registration and publication fees are paid, the decision is published in the Official Bulletin and the short-term patent is issued. Term for payment of the prescribed fees is 2 months from the date of receipt of the decision. The term of validity of the short-term patent in Moldova is 6 years counting from the filing date. This term may be extended by 4 additional years provided that the substantive examination is requested within the first 6 months of the 6th year of patent validity and the positive decision of the examination is issued. If no substantive examination is requested, the patent expires after expiration of the 6-year term.

The procedure of the short-term patent registration in Moldova takes about 1 to 2 years.

Foreign applicants must be represented before the Office by a registered Moldavian patent attorney.

For filing a short-term patent application in Moldova we need:

  • your filing instructions with applicant's and inventor's names, addresses and citizenships;
  • filing number and date of priority application or PCT application;
  • specification with claims, abstract and drawings;
  • Power of Attorney simply signed and stamped by the applicant(s), legalization and notarization are not required (may be provided to the Moldavian Patent Office within 2 months from filing the application);
  • for conventional applications - Certified copy of the priority document, if priority is claimed (may be provided to the Moldavian Patent Office within 16 months from the priority date).

The term for filing a short-term patent application claiming priority in Moldova is 12 months from the priority date. The term for entering the Moldavian national phase of a PCT application as short-term patent is 31 months from the priority date.
