Since January 15, 2024, the procedure for the validation of European patents in Georgia (Sakartvelo) is available. Under the agreement signed by the European Patent Office and the Georgian government, applicants are able to validate their European patent applications and patents in Georgia.
Validation Procedure
Validation in Georgia is only possible if Georgia was explicitly selected as a validation state at the time of filing your European patent application (filed on or after January 15, 2024). Validated EPs have the same legal effect as national patents and are governed by Georgian law.
-
1Step 01Designation of Georgia
Validation of the European patent in Georgia requires the payment of the designation fee.
-
2Step 02Mention of Grant Publication
Official publication of the mention of grant in the European Patent Bulletin.
-
3Step 03Validation of European Patent
Preparation of the Georgian translation and submission of the validation request with the POA.
-
4Step 04Full Protection
Maintenance of the patent's legal force and monitoring of renewal fees.
Note for Step 01: Validation of the European patent in Georgia may be obtained only in case the required designation fee for this country in the amount of 200 EUR is paid within 6 months from publication of the European search report in respect of the European patent application for conventional applications, while for PCT applications the designation should be made simultaneously with filing.
Note for Step 03: Preparation of the high-quality Georgian translation of the specification by technical experts and submission of the validation request together with the payment of the official fees to the Georgian Patent Office within 3 months from the publication of mention of grant of the European patent in the European Patent Bulletin together with the executed POA from the applicant.
Validation Requirements
OFFICIAL FEES
The official designation fee for Georgia is 200 EUR. It must be paid to the EPO
within six months of the European search report publication (a 2-month grace period is available with
a 50% surcharge). Please note that re-establishment of rights is not available for this deadline.
Following the grant, a national publication fee is payable directly to Sakpatenti (Georgian National IP Office) along with the submission of the translation. Annual renewal fees for validated European patents are payable to Sakpatenti starting from the year following the publication of the grant mention.
TRANSLATION
Georgian translation of the patent specification, certified by a registered Georgian patent attorney,
has to be filed with Sakpatenti (Georgian PO) within three months from publication of the mention of a
grant by the EPO, along with paying the validation fees. If the three-month deadline is missed, the
patent proprietor may still file the translation and pay the publication fee within a further
three-month grace period, provided they pay a 100% surcharge on the prescribed publication fee.
Georgian PO checks the conformity of the translation of the claims with the authentic text of the EP
patent and in case of any discrepancies, issues an Office action.
LOCAL REPRESENTATION
In accordance with national law, foreign applicants must be represented by a registered Georgian
patent attorney. Our firm provides full legal support and handles all communication with the
Sakpatenti on your behalf.
UNITARY PATENT (UP) COMPLIANCE
Since Georgia is a validation state and not a member of the EU, it is not covered by the Unitary
Patent (UP) system; therefore, national validation remains the only route for EP protection in this
jurisdiction.
