A European patent granted by the European Patent Office (EPO) can provide protection in up to 46 countries, including EPO member states, extension, and validation states. Under the London Agreement, the validation process is significantly simplified in certain jurisdictions; for instance, countries such as Germany, France, and Switzerland no longer require a translation of the patent specification to maintain the patent's effect. However, in most other jurisdictions, including Latvia, specific national validation procedures must be completed within prescribed deadlines to ensure enforceable legal rights.
Validation Procedure
Our company offers the European patent validation service in Latvia. The deadline for filing the validation request to Latvian Patent Office is 3 months from the publication of mention of grant of the European patent in the European Patent Bulletin. Failure to meet this deadline results in the permanent loss of patent rights in Latvia — the European patent will have no legal effect in this jurisdiction from its filing date.

approximately 90 EUR). To maintain the patent in force, annual renewal fees must be paid to the
Latvian Patent Bureau (Patentu valde).
TRANSLATION

to submit translation of the claims into Latvian language to the Patent Office. The Patent Office
verifies the conformity of the translation with the original text, and any discrepancies may lead to
an Office Action.
LOCAL REPRESENTATION

attorney. Our firm provides full legal support and handles all communication with the Latvian Patent

Unitary Patent System in Latvia
Since the launch of the Unitary Patent (UP) system on June 1, 2023, which currently covers 18 countries including Latvia, applicants before the European Patent Office (EPO) may opt for unitary protection instead of pursuing traditional national validation. While the Unitary Patent offers significant benefits, it is essential to weigh its strategic impact carefully. Notably, invalidation of a Unitary Patent results in the loss of rights across all 18 participating states simultaneously, rather than on a country-by-country basis. Given these considerations, securing traditional validation in Latvia remains a highly advisable route for maintaining strong, predictable, localized protection. Our experienced patent team is ready to guide you through the EPO validation process in Latvia to ensure your rights are fully preserved.
Comparison: National Validation vs. Unitary Patent (UP)
| Feature | National Validation in Latvia | Unitary Patent (UP) |
|---|---|---|
| Coverage | Latvia only (individual protection) | 18 EU countries (including Latvia) |
| Translation | Claims into Latvian language | Depends on the language of proceedings |
| Risk Management | Independent validity (safe from "central attack") | If revoked, patent dies in all 18 countries |
|
Non-EU/Validation States (Georgia, Turkey, etc.) |
Possible (via separate procedure) | Not covered |
